Who Is at Fault in a Three-Vehicle Highway Accident?
Determining fault after a multi-vehicle collision on Highway 401 can be difficult.

Investigators may review following distances, lane changes, speed and road conditions.
Dashcam footage and witness statements can help establish the order of events.

An experienced Whitby car accident lawyer can review the evidence and identify parties who may be legally responsible.
Can Families Sue After a Fatal Highway 401 Collision?
When a person dies because of another party’s negligence, eligible family members may have grounds for a wrongful death claim in Ontario.
Under Ontario’s Family Law Act, certain relatives may seek compensation for funeral expenses, lost financial support, lost household services and loss of care, guidance and companionship.
A wrongful death claim is separate from any criminal investigation.
Police do not need to lay criminal charges for a civil lawsuit to be possible. However, negligence must still be established.
What Insurance Benefits Are Available After a Fatal Car Accident?

Eligible family members may qualify for death and funeral benefits under the applicable insurance policy.
Injured survivors may also qualify for treatment, rehabilitation and other covered benefits.

A Durham Region personal injury lawyer can help families review the available coverage and important claim deadlines.
Why Do Vehicle Fires Complicate Accident Investigations?
A vehicle fire can cause severe injuries and destroy important evidence.
Investigators may need to examine burned vehicle components, collision damage and electronic vehicle data.
They may also review whether the fire started because of the impact or another factor.
However, a vehicle catching fire does not automatically mean a mechanical defect caused the collision.
The cause of the November 1 Whitby crash remains under investigation.
