Toronto Police are investigating a fatal hit-and-run in Scarborough after a 35-year-old man was struck and killed early Friday morning.
Emergency crews responded at about 1:52 a.m. on October 2, 2026, near Midland Avenue and Kilcullen Castle Gate, south of McNicoll Avenue. Police said the man was lying face down in the southbound lanes of Midland Avenue when a southbound vehicle struck him. The driver then left the area. The pedestrian was pronounced dead at the scene.
Police said that, because of the circumstances and weather conditions, the driver may not have realized they had struck a pedestrian. Police initially released no description of the vehicle. Toronto Police Traffic Services is investigating.
Anyone who was in the area or has dashcam or security camera footage is being asked to contact Toronto Police.
What Happens After a Fatal Hit-and-Run in Toronto?
A fatal pedestrian hit-and-run can lead to several separate investigations.
Police will work to identify the vehicle and driver. They may review surveillance video, dashcam footage, vehicle debris, witness statements and other evidence from the scene.
At the same time, the victim’s family may need to understand the insurance and legal issues that follow a fatal collision.
One important point is that a driver leaving the scene does not necessarily prevent a family from exploring a potential claim. Different insurance options may be available even when the vehicle or driver has not yet been identified.
What If the Hit-and-Run Driver Is Never Identified?
Ontario insurance policies can include coverage that may apply when an at-fault driver cannot be identified. The exact coverage depends on the facts of the collision and the insurance policies involved.
The Motor Vehicle Accident Claims Fund may also become relevant in certain cases when other sources of insurance are unavailable. It is generally considered a payer of last resort and has its own eligibility requirements.
A Scarborough hit-and-run lawyer can investigate which insurance options may apply rather than assuming there is no claim because the driver has not been found.
Can a Family File a Wrongful Death Claim After a Hit-and-Run?
Potentially. However, a successful claim depends on the evidence and the circumstances of the collision.
Certain family members may be able to seek compensation when another person’s negligence causes a death. Depending on the case, recoverable damages may include eligible financial losses and compensation for the loss of care, guidance and companionship.
A wrongful death claim in Ontario is separate from any criminal investigation or charges.
If police eventually identify the driver, a lawyer can investigate whether that person’s actions meet the legal requirements for a civil claim.
How Is Fault Determined in This Scarborough Pedestrian Accident?
This collision presents an important issue.
Police reported that the 35-year-old pedestrian was lying in the roadway when he was struck. They also said the driver may not have realized a collision had occurred because of the circumstances and weather.
Those facts make it important not to assume fault.
Investigators may examine lighting, visibility, weather, vehicle speed, road conditions and how long the pedestrian was in the roadway. They may also consider whether the driver had a reasonable opportunity to see and avoid the pedestrian.
In Ontario, responsibility can sometimes be shared between different parties. The evidence determines whether negligence occurred and how liability should be divided.
Why Is Video Evidence Important in a Hit-and-Run Investigation?
Video can provide answers that may not be available from the collision scene alone.
Toronto Police are asking anyone with dashcam or security footage from the area to come forward.
A recording could show the vehicle before or after the impact. It could help identify its make, model, colour or licence plate. Video may also establish traffic, weather and visibility conditions at the time.
This evidence can disappear quickly. Many businesses and residential camera systems automatically overwrite recordings.
For families considering a fatal pedestrian accident claim, identifying and preserving available evidence should therefore be done as early as possible.
Are Accident Benefits Available After a Fatal Pedestrian Accident?
Ontario’s Statutory Accident Benefits system can apply when a pedestrian is involved in a motor vehicle collision.
The benefits available after a fatal accident depend on the circumstances and applicable insurance coverage. There may also be specific benefits available to eligible family members.
This is separate from a potential lawsuit.
A Toronto personal injury lawyer can review the available policies, determine which insurer should be contacted and explain what benefits may apply.
