An 83-year-old woman has died after being struck by a vehicle in Markham, Ontario, on Saturday, October 31, 2026.
The fatal pedestrian accident happened near 16th Avenue and Markham Road at approximately 5:40 p.m.
Emergency crews rushed to the scene, where the woman had suffered critical injuries. Despite efforts to save her life, she later died in hospital.

The tragedy highlights the dangers faced by older pedestrians and raises questions about driver responsibility, pedestrian safety and wrongful death claims in Ontario.
What Happened in the Fatal Markham Pedestrian Collision?
York Regional Police responded to reports of a pedestrian struck near the intersection of 16th Avenue and Markham Road. Officers found the woman on the roadway with life-threatening injuries.
Members of the public and first responders provided emergency care before she was transported to hospital. Sadly, the 83-year-old woman did not survive.
The York Regional Police Major Collision Investigation Unit is examining what happened. Police have not confirmed the cause of the crash or whether charges will be laid.
Why Are Older Pedestrians at Greater Risk?
A car accident can cause serious harm to anyone walking near traffic. For older adults, the effects can be especially severe. As people age, their bones may become more fragile. They may also have a harder time recovering from serious injuries. A collision can cause broken bones, head injuries, internal bleeding or damage to the spine. Even a crash at a relatively low speed can have devastating results. Drivers must watch for pedestrians, especially near intersections, crosswalks and busy roads.
Investigators have not determined what caused the October 31 Markham pedestrian accident.
Who Is Responsible When a Driver Hits a Pedestrian?
Fault depends on the circumstances of the collision.
Police may review vehicle speed, traffic signals, visibility and witness statements.
Under section 193 of Ontario’s Highway Traffic Act, a driver or vehicle owner may have to prove that a pedestrian’s injury did not result from their negligence or improper conduct.
This rule can be important in a pedestrian accident lawsuit in Ontario.
However, it does not mean every driver is automatically at fault.
An experienced Markham pedestrian accident lawyer can review the evidence and determine whether negligence contributed to the collision.
Can Families Sue After an Elderly Pedestrian Is Killed?
When another person’s negligence causes a fatal accident, certain family members may have grounds for a wrongful death claim in Ontario.
Under Ontario’s Family Law Act, eligible relatives may seek compensation for funeral expenses, lost financial support and loss of care, guidance and companionship.
A wrongful death claim does not depend on the victim’s age alone.
Older adults provide emotional support, care and guidance to their families. These relationships may be relevant when assessing eligible losses.
However, negligence must still be established before a lawsuit can succeed.
What Insurance Benefits Are Available After a Fatal Pedestrian Accident?
Ontario’s Statutory Accident Benefits system may provide support following a fatal motor vehicle collision, regardless of fault.
Eligible family members may qualify for death and funeral benefits under the applicable insurance policy.
A pedestrian does not need to own a vehicle to potentially qualify for benefits.
Ontario has rules that determine which insurer must handle the claim.
Insurance changes introduced on July 1, 2026, also make it important to review the coverage in effect.
