This is why some injured persons settle for what the liable party's insurance company offers them or even fail to pursue compensation. The money provided by the insurance company may help out with your current medical bills in the short term. But, what happens in the future if you require more treatment or can’t work due to the impact of your injury?
Getting the right legal representation stops you from making costly mistakes. A good attorney will thoroughly review all the elements of your case and ensure that the settlement you get will cover all your current and future needs.

What You Can Recover in an Accident Claim
As provided by the Ontario government, injured persons may be entitled to compensation by the liable party’s insurance provider. This can be obtained through settlement negotiations or a trial. But what damages are covered in a personal injury case? How much can you recover after an injury?
The value of a personal injury claim is determined by many factors, including the severity of your injuries and their impact on your life. Without proper legal guidance, there's a possibility of omitting certain damages that you've suffered, leading to less recompense. A committed personal injury lawyer can help you estimate the damages you've suffered and ensure favourable compensation.
Some of the damages in personal injury claims include:
- Current and future medical expenses
- Caregiver costs
- Lost income
- Pain and suffering
- Loss of the ability to enjoy life
- Impacts on your ability to earn
- Punitive damages (in exceptional circumstances)
- Damages for a wrongful death

How long do I have to file a Whitby personal injury lawsuit?
According to the Ontario Limitation Act, claimants generally have two years from the accident date to file their case. However, some exemptions to this limitation exist. The deadline may be extended if the claimant was a minor when the accident occurred or discovered the injury sometime later after the incident.
The limitation period is much shorter when filing a claim against any government agency. In such cases, you may only have ten days to file your claim. Therefore, it's crucial to enlist the services of a lawyer as soon as possible after an accident.
How do I prove who was liable for my injuries?
To establish that another party is liable for your injuries, you must prove the following:
- Duty – show that the at-fault party owed you a duty of care. A duty of care is a legal duty that refers to how a reasonable person would act in the same situation to prevent harm.
- Breach – the at-fault party breached the duty of care owed to you. For example, a motorist texting when driving instead of focusing on the road is a breach.
- Causation – show that the at-fault party's negligence was the cause of your injuries.
- Damages – as the plaintiff, you have to show that the resulting injuries caused damages in your life, for example, medical bills, pain and suffering, and lost wages.
Will my personal injury claim have to go to court?
Most personal injury claims resolve without having to go to court. This usually occurs through a settlement negotiation between the plaintiff's lawyer and the at-fault party's insurance provider. However, some injury cases do not settle and end up in court.
Bergel Magence lawyers are as experienced handling settlement negotiations as they are fighting for your compensation inside the courtroom.
